The Moscow Ninth Appellation Court upheld the decision under the lawsuit of designer Christian Louboutin against Russian perfumery suppliers. The Moscow Arbitration Court earlier ordered to collect over 24 million rubles ($375,445) for violation of trademark rights.
“The decision of the Moscow Arbitration Court of April 22, should be left unchanged and appeals should not be sustained”, Judge Natalia Levchenko said at the session. The decree may be appealed in two months in the court for intellectual rights, she added.
Russian companies therefore received the court refusal to sustain appeals filed against the earlier award of the Moscow Arbitration Court on collection of damages under the lawsuit filed by Christian Louboutin and his company Christian Louboutin S.A.S. Earlier in April, the Moscow Arbitration granted judgment in favor of the designer and Christian Louboutin S.A.S. on recovery of more than 24 million rubles ($375,445) from four Russian companies (InterLuxPerfume, Interprestige Group, Image Perfume and Clementina). The court ruled they had unlawfully used trademarks owned by Louboutin.
